FreshPOP Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FreshPOP website and store at freshpop.co.za (the "Site"), operated from South Africa. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who can use this Site

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order on this Site. Certain products, including the UV Whitening Kit, are not suitable for anyone under 16 regardless of who places the order — see the relevant product page for full safety information.

2. Products and pricing

All prices on the Site are listed in South African Rand (ZAR) and include VAT where applicable. We make reasonable efforts to ensure product descriptions, images, and pricing are accurate, but errors may occur. If we discover a pricing or listing error after you've placed an order, we will contact you before processing the order and you may choose to proceed at the corrected price or cancel.

We reserve the right to limit quantities, refuse service, or cancel orders at our discretion, including in cases of suspected fraud or abuse of promotional offers.

3. Orders and payment

By placing an order, you confirm that the payment and delivery information you provide is accurate and complete. Orders are only confirmed once payment has been successfully processed. We accept the payment methods listed at checkout.

4. Shipping and delivery

We ship nationwide within South Africa via Aramex. Delivery timeframes, fees, and out-of-stock procedures are set out in our Shipping Info page. Delivery estimates are not guaranteed and may be affected by factors outside our control, including courier delays.

5. Returns, refunds, and warranty

Our return, refund, and warranty terms — including our no-returns-on-opened-products policy for hygiene reasons, and the 6-month warranty on the Electric Toothbrush and UV Whitening Kit — are set out in our Refund Policy.

6. Product use and safety

Our whitening products are intended for use as directed on the product packaging and product pages. They are not suitable for everyone — please review the safety information on each product page, including age restrictions, pregnancy/breastfeeding guidance, and contraindications for damaged enamel, ceramic crowns, or false teeth, before use. If in doubt, consult a dentist or medical professional before use.

We are not liable for adverse reactions resulting from use of our products contrary to the instructions provided, or by individuals for whom the product is not recommended.

7. Intellectual property

All content on this Site — including text, graphics, logos, and images — is owned by or licensed to FreshPOP and may not be copied, reproduced, or used without our written permission.

8. Acceptable use

You agree not to use the Site for any unlawful purpose, to attempt unauthorised access to our systems, or to interfere with the proper functioning of the Site.

9. Limitation of liability

To the maximum extent permitted by law, FreshPOP shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products, beyond the value of the relevant order. Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded.

10. Governing law

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms or your use of the Site will be subject to the jurisdiction of the South African courts.

11. Changes to these Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
